Terms of Service

All terms are governed by the laws of the United States and the State of South Carolina.

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Cooling-Off Period: The period during which the consumer may exercise their right of withdrawal;

Consumer: A natural person who is not acting for purposes related to a trade, business, or profession and who enters into a distance contract with the entrepreneur;

Ongoing Contract: A distance contract relating to a series of products and/or services, where the obligations are spread over a period of time;

Right of Withdrawal: The consumer’s ability to cancel the distance contract within the cooling-off period;

Entrepreneur: The natural or legal person offering products and/or services remotely to consumers;

Distance Contract: A contract concluded between the entrepreneur and the consumer using one or more techniques for remote communication;

CESOP: The Central Electronic System of Payment Information established by the European Union for monitoring payment service providers.

Article 3 – Applicability

These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer. Before the agreement is finalized, these terms and conditions will be made available electronically or by other appropriate means.


Article 4 – The Offer

Offers are non-binding. Eva’s Boutique Charleston reserves the right to modify or withdraw offers at any time.

The offer clearly states the total price, including shipping costs, applicable taxes, customs duties, and any additional charges that may be collected by postal or courier services.


Article 5 – The Agreement

The agreement is concluded once the consumer accepts the offer and complies with the stated conditions. Eva’s Boutique Charleston will confirm acceptance of the order promptly by email.


Article 6 – Right of Withdrawal

Consumers have the right to cancel their order within 14 days of receiving the product without providing a reason. Return shipping costs are the responsibility of the consumer.

ARTICLE 6A – EXCLUSIONS FROM THE RIGHT OF WITHDRAWAL

Items discounted by 40% or more are considered final sale and cannot be returned, refunded, or exchanged. Sale items discounted less than 40% may be returned in accordance with our Return Policy.


Article 7 – Costs in Case of Withdrawal

Eva’s Boutique Charleston will reimburse payments within 14 days after receiving the returned product, provided the item is returned in its original condition, including all original packaging.


Article 8 – Customs, Import Duties, and VAT Liability

8.1

All goods are shipped under Delivered Duty Unpaid (DDU) terms. The customer is responsible for all import-related costs.

8.2

These costs may include, but are not limited to:

(a) Import duties, VAT/GST, and other taxes;
(b) Customs clearance fees;
(c) Compliance with local laws and import regulations.

8.3

Eva’s Boutique Charleston is not the importer of record. Legal ownership of products transfers to the customer upon shipment.

8.4

Eva’s Boutique Charleston provides shipping documentation but cannot guarantee compliance with regulations in destination countries.

8.5

The customer agrees to indemnify and hold harmless Eva’s Boutique Charleston against any import-related claims, fees, or penalties.

8.6

Customers are strongly encouraged to contact their local customs office before placing an order.


Article 9 – CESOP Compliance

Beginning in 2024, payment data may be reported to CESOP in accordance with applicable European Union regulations. Eva’s Boutique Charleston complies with all applicable reporting obligations.


Article 10 – Conformity and Warranty

Products supplied by Eva’s Boutique Charleston comply with applicable legal requirements and the terms of the agreement.

  • Any defects or issues must be reported within 14 days of delivery.
  • Returned products must be in their original condition and packaging.

Article 11 – Delivery

Orders will be delivered within 30 days unless otherwise agreed.

If delays occur, the customer will be informed within 14 days.

The customer is responsible for handling all import procedures and related obligations.

Eva’s Boutique Charleston ensures lawful shipment of products but is not responsible for delays caused by customs authorities.

Failure to comply with import regulations or customs requirements does not qualify as grounds for cancellation or refund.


Article 12 – Complaint Resolution

Complaints must be submitted in writing within 7 days after the issue is discovered.

Eva’s Boutique Charleston will respond within 14 days or provide an estimated timeline for resolution.


Article 13 – Disputes

These terms and conditions are governed by the laws of the United States and the State of South Carolina.

Any disputes will preferably be resolved amicably. If necessary, disputes will be submitted to the appropriate courts located in South Carolina, United States.
